We do not use, or permit our service providers to use, customer confidential information, candidate resumes, interview content, assessment responses, or sensitive personal information to train third-party general-purpose artificial intelligence models;
- advertise, remarket, measure campaigns, evaluate engagement and attribution, infer the business organization associated with website activity, and, in limited cases, match previously unidentified website activity with a likely business contact or professional profile for B2B sales, marketing, analytics, lead-generation, and business-development purposes. Such inferences may be incomplete or inaccurate. We do not use website-visitor identification information to evaluate candidates, make employment decisions, or infer sensitive characteristics;
- create aggregated, statistical, anonymized, or deidentified information and use or disclose it for legitimate business purposes. We maintain deidentified information in deidentified form and do not attempt to reidentify it, except as permitted by law to test or validate our deidentification processes. Pseudonymized information remains personal information and is handled in accordance with this Privacy Policy;

We use work-authorization or immigration information only as necessary to assess legal eligibility for a role, support sponsorship or onboarding, or comply with law.
3.2 Automated Tools and Human Review
We may use software-assisted tools to organize, parse, search, compare, score, prioritize, or recommend candidates, roles, applications, assessments, and business opportunities.
We do not make final decisions that produce legal or similarly significant effects solely through automated processing where prohibited by applicable law. Automated outputs may be reviewed, supplemented, disregarded, or overridden by authorized personnel or by the relevant customer.
Where applicable, individuals may request information about the use of automated tools, opt out of certain uses, request human review, express their point of view, or contest a decision. Additional information is provided in the Persona AI Transparency and Human Review Notice and in any workflow-specific notice required by applicable law.

The companies described in this Section are treated as service providers, contractors, or processors only for activities in which they process personal information on our behalf, under our instructions, and subject to contractual restrictions. If a provider uses personal information for its own purposes or across customers, that activity is addressed in Section 4.4.
4.3 Customers, Prospects, Candidates, and Counterparties
Where relevant to the Services, we may disclose personal information to customers, prospective customers, candidates, talent, contractors, business partners, referral sources, and other counterparties in connection with evaluating opportunities, matching roles, interviewing, onboarding, staffing, support, or service delivery.
4.4 Advertising, Analytics, Visitor-Identification, Data-Enrichment, and Social Media Partners
We may disclose or make available identifiers, device and browser information, cookie and tracking data, internet or other electronic network activity, approximate location, commercial information, and inferences to advertising, social media, analytics, attribution, website-visitor identification, and data-enrichment partners that use the information for their own purposes or across customers.
We use these partners for targeted advertising, audience building, remarketing, campaign measurement, attribution, B2B lead generation, and related analytics. Depending on applicable law and the partner’s role, these disclosures may constitute a sale, sharing, or targeted advertising.
You may exercise applicable opt-out rights as described in Sections 8 and 12.4.
4.5 Professional Advisors and Authorities
We may disclose personal information to attorneys, insurers, auditors, regulators, law enforcement, government entities, tax authorities, courts, and other parties where reasonably necessary to comply with law, legal process, investigation, or to protect rights, property, or safety.

4.7 With Your Direction or Consent
We may disclose personal information to third parties when you direct us to do so or otherwise consent.
4.8 Aggregated and Deidentified Information
We may disclose aggregated, deidentified, anonymized, or statistical information for any lawful purpose.
5. SMS and Mobile Communications Privacy
If you provide your mobile phone number and opt in to receive SMS messages from us, we may collect and process your mobile number, messaging preferences, records of consent and opt-in (including the source, method, date, time, form, and context of consent), opt-out and HELP requests, message logs, delivery logs, carrier information, and related identifiers reasonably necessary to operate, secure, troubleshoot, document, and improve our messaging program.
We use this information to send and receive conversational, follow-up, reminder, scheduling, service-related, support, recruiting, onboarding, account-related, and, where separately consented to, promotional messages; to maintain records of consent and suppression; to honor opt-out requests; to measure deliverability and performance; to comply with legal, carrier, and platform requirements; and to protect against fraud, abuse, and misuse.
Message frequency varies. Message and data rates may apply. Consent is not a condition of purchase or use of our services. You can opt out at any time by replying STOP to any message. For help, reply HELP or contact us at [email protected].
We may use service providers to support and deliver text messages. However:
No mobile information will be shared with third parties or affiliates for their own marketing or promotional purposes. We do not sell, rent, share, or transfer your mobile phone number, SMS opt-in data, or SMS consent records to third parties or affiliates for their own marketing or promotional purposes.
This restriction applies notwithstanding anything else in this Privacy Policy that could otherwise be read more broadly.
We may retain mobile numbers, consent records, suppression status, message preferences, and related logs for as long as reasonably necessary to provide the messaging program, document consent, maintain do-not-contact records, comply with law, resolve disputes, and enforce our agreements.
6. Cookies and Similar Technologies
We and our service providers and partners use cookies, pixels, tags, scripts, local storage, software development kits, APIs, session-replay tools, and similar technologies to collect information about use of the Services.
We use these technologies to:
- provide, maintain, authenticate, and secure the Services;
- remember settings and preferences;
- understand traffic, performance, usage, and engagement;
- diagnose errors and improve the Services;
- measure marketing and campaign performance;
- personalize content and communications;
- support social media features;
- provide targeted advertising and remarketing;
- identify or infer business organizations and business contacts associated with website visits; and
- honor consent and privacy preferences.
Website-Visitor Identification and B2B Enrichment
We use third-party website-visitor identification and B2B data-enrichment services. These services may process IP address, device and browser information, pages viewed, referring URLs, interaction timestamps, business-domain signals, and similar information to infer the organization associated with a website visit and, in limited cases, match previously unidentified website activity with a likely business contact or professional profile.
The resulting matches may be incomplete or inaccurate. We use this information for B2B analytics, attribution, lead generation, marketing, and business development. We do not use this information to evaluate candidates, make employment decisions, or infer sensitive characteristics.
Consent and Controls
Where consent is required by applicable law, we do not activate non-essential cookies, pixels, tags, scripts, SDKs, session-replay tools, website-visitor identification technologies, person-level enrichment technologies, or similar tracking technologies until you provide consent.
You may reject non-essential technologies or withdraw consent at any time through our Privacy Choices or Cookie Settings tool. Withdrawing consent does not affect processing that occurred before withdrawal. Blocking some technologies may affect certain functions of the Services.
Consent is not required for technologies that are strictly necessary to provide a service requested by you, maintain security, authenticate users, remember privacy preferences, or perform another exempt function under applicable law.
Where we use session-replay tools, we configure them to mask form inputs and disable them on application, assessment, accommodation, payment, identity-verification, and other pages designed to collect sensitive personal information.
Opt-Out Preference Signals
Where required by applicable law, we process recognized opt-out preference signals, such as Global Privacy Control, as a request to opt out of sale, sharing, and targeted advertising for the browser or device sending the signal. Where required, our interface will indicate that the signal has been honored.
We do not respond to browser Do Not Track signals unless required by law.
7. Lawful Bases for Processing in the EEA and United Kingdom; Swiss Processing
If you are located in the European Economic Area or United Kingdom, we rely on one or more of the following lawful bases, depending on the processing activity:
- Contract or steps taken at your request. We process personal information to provide requested services, respond to applications or inquiries, administer an engagement, or perform an agreement.
- Legitimate interests. We process personal information to operate, secure, and improve the Services; manage customer, candidate, vendor, and business relationships; source and match candidates with opportunities; conduct proportionate B2B marketing; prevent fraud and misuse; and establish, exercise, or defend legal claims, where those interests are not overridden by your rights and interests.
- Consent. We rely on consent for non-essential cookies and similar technologies, certain website-visitor identification or person-level enrichment activities, certain recordings, promotional communications, SMS messages, sensitive information, or other processing where consent is required.
- Legal obligation. We process personal information to comply with employment, tax, accounting, regulatory, recordkeeping, law-enforcement, and other legal requirements.
- Vital interests or public interest. In limited circumstances, we may process personal information to protect vital interests or perform processing authorized in the public interest.
Where we process special-category or otherwise sensitive personal data, we rely on an applicable additional legal condition, such as explicit consent, employment or social-protection law, protection of vital interests, establishment or defense of legal claims, or another condition permitted by law.
Where we rely on consent, you may withdraw it at any time. Where we rely on legitimate interests, you may object to the processing. Withdrawal or objection does not affect processing that was lawful before it took effect.
If you are located in Switzerland, we process personal information in accordance with the Swiss Federal Act on Data Protection and obtain consent where required, including for certain sensitive-personal-data or high-risk profiling activities.
8. Sale, Sharing, and Targeted Advertising
Some U.S. state privacy laws define “sale,” “sharing,” and “targeted advertising” broadly to include certain disclosures for advertising, cross-context behavioral advertising, website-visitor identification, analytics, attribution, or data enrichment, even when no money is exchanged.
In the preceding 12 months, we have sold or shared the following categories of personal information: identifiers; device and browser information; internet or other electronic network activity information; approximate geolocation; commercial information; and inferences.
We have sold or shared these categories with advertising and social media platforms, analytics and attribution partners, and website-visitor identification and B2B data-enrichment partners for targeted advertising, audience building, remarketing, campaign measurement, attribution, B2B lead generation, and related analytics.
We do not knowingly sell or share personal information of individuals under 16 where opt-in consent is required.
We do not sell, rent, share, or transfer mobile phone numbers, SMS opt-in data, or SMS consent records to third parties or affiliates for their own marketing or promotional purposes.
You may opt out of sale, sharing, and targeted advertising through the Your Privacy Choices link in our website footer or by using a recognized opt-out preference signal, such as Global Privacy Control, where required by law. You may also contact us as described in Section 12.1. Where required, we provide a means to confirm that an opt-out request has been honored.
9. Retention of Personal Information
We retain each category of personal information only for as long as reasonably necessary and proportionate to the disclosed purpose, subject to applicable legal, accounting, security, fraud-prevention, and dispute-resolution requirements.
Our planned retention periods or criteria are:
- Website, cookie, analytics, attribution, website-visitor identification, and B2B enrichment information: for the period disclosed in our cookie or privacy settings and ordinarily no longer than 24 months after collection, unless a longer period is necessary for security, fraud prevention, legal compliance, or a legal claim.
- B2B prospect, marketing-contact, and business-development information: up to 3 years after the last meaningful interaction, unless the individual opts out earlier or minimal information must be retained to honor an opt-out or do-not-contact request.
- Candidate and applicant information: as described in the Persona Candidate Privacy Notice. Application-only records are generally retained for at least 12 months after the later of the relevant role’s closure or our last meaningful contact and ordinarily not beyond 5 years absent a legal, security, fraud-prevention, or claims-related need. Profiles maintained for future opportunities remain active while there has been meaningful contact within the preceding 24 months and are subject to the renewal and deletion process described in that Notice.
- Call, video, meeting, screen, and session-replay recordings and transcripts: up to 12 months after creation, unless a longer period is necessary for an active recruiting, customer, security, compliance, or legal matter.
- Customer, vendor, contract, invoice, payment, tax, and accounting records: 7 years after the end of the relevant relationship or transaction, unless a longer period is required by law.
- Employment, contractor, payroll, benefits, onboarding, and compliance records: for the duration of the relationship plus 7 years, or the longer period required by applicable law.
- SMS and communication-consent records: for the duration of the communication program and at least 4 years after the last message or consent event. Suppression and do-not-contact records are retained for as long as necessary to honor the request.
- Security, fraud-prevention, authentication, and access logs: up to 24 months after collection, unless needed longer to investigate an incident, prevent fraud, comply with law, or protect legal rights.
- Sensitive personal information: for the shortest period reasonably necessary for the purpose for which it was collected and any applicable legal obligation.
- Deidentified or aggregated information: for as long as it remains deidentified or aggregated and useful for legitimate business purposes.
We may suspend deletion when information is subject to a legal hold, dispute, investigation, audit, regulatory inquiry, security incident, or other preservation obligation.
When retention is no longer necessary, we delete or deidentify the information in accordance with our procedures. We may retain minimal suppression information, such as a hashed email address or similar identifier, indefinitely and solely to honor deletion, opt-out, objection, and do-not-contact requests and prevent unwanted re-import or re-contact.
10. International Data Transfers
We operate from the United States and may use service providers, affiliates, customers, and other recipients that process personal information in the United States and other countries. As a result, personal information may be transferred to and processed outside the jurisdiction where it was collected.
Where required by applicable law, we use appropriate safeguards for international transfers, such as contractual transfer clauses, recognized transfer frameworks, adequacy decisions, supplementary safeguards, or other lawful transfer mechanisms.
You may request additional information about safeguards applicable to your personal information by contacting us at [email protected].
11. Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no method of transmission, storage, or security control is completely secure. We cannot guarantee absolute security. You are responsible for using appropriate security measures, safeguarding credentials, and exercising caution when submitting information over the internet or by text message.
11.1 Our Role
For personal information collected and used for our own website, marketing, recruiting, business-development, administration, security, and business operations, Psychometric, Inc. generally acts as a controller or business.
When we process personal information solely on behalf of a customer under a contract, we act as a processor, service provider, or contractor. In that context, the customer controls the relevant processing, and we may refer or coordinate a privacy request with that customer.
12. Your Privacy Rights and Choices
Depending on where you live and subject to applicable legal limitations and exceptions, you may have the right to:
- know whether we process your personal information and obtain information about the processing;
- access or obtain a copy of your personal information;

- appeal certain decisions regarding privacy requests;

We may decline or limit requests as permitted by law, including where we cannot verify identity, an exception applies, or the request is manifestly unfounded, excessive, repetitive, or otherwise not required to be fulfilled.

12.3 Marketing Communications

You can opt out of SMS messages by replying STOP. You may also revoke consent by other reasonable means permitted by law.
12.4 Cookies, Sale, Sharing, and Targeted Advertising
You can manage non-essential cookies and similar technologies through our Privacy Choices or Cookie Settings tool.
Where applicable, you may opt out of sale, sharing, and targeted advertising through the Your Privacy Choices link in our website footer.
We also process recognized opt-out preference signals, such as Global Privacy Control, where required by applicable law. Where required, our interface will indicate when an opt-out preference signal or other opt-out request has been honored.
Cookie controls and sale, sharing, or targeted-advertising opt-outs are separate from email and SMS unsubscribe choices.
